Republicans plan to pressure Perdue, Cooper to join health care lawsuit

There will be calls Tuesday morning for Gov. Bev Perdue and Attorney General Roy Cooper, both Democrats, to join the lawsuit challenging the constitutionality of the new federal health care law.

At the Council of State meeting, Labor Commissioner Cherie Berry and Agriculture Commission Steve Troxler, both Republicans, plan to urge Perdue and Cooper to join 13 other states challenging the law, Rob Christensen reports.

"We hope that your appreciate our concern that for the benefit of all North Carolinians, the legal and constitutional questions surrounding this federal legislation be resolved as quickly as possible in a federal court with the support of the N.C. Council of State," Berry and Troxler wrote in a letter for the governor asking that the issue be put on the agenda.

Meanwhile, on the Halifax Mall outside the meeting, state chapter of Americans for Prosperity, the anti-tax, small government group, plans to hold a rally calling on Perdue and Cooper to join the lawsuit.

"'The Patient Protection and Affordable Care Act' was an enormous overreach of federal power that encroaches on state sovereignty and our freedom,” wrote Bill Gilbert, the group's grassroots coordinator in an e-mail message urging supporters to attend the rally.

"With the stroke of a pen, the law of the land will now require every American citizen to either secure federally regulated health insurance or risk having to pay harsh penalties, and even spend time in jail."

Thanks to all of you who are giving us intelligent responses! When people comment on things they know absolutely NOTHING about, i.e., who the Canadian prime minister happens to be, it is great that we have people who can set the record straight.

Waste of time

When is the "party of no" going to start doing something for the American people instead of desperately trying to get their power back. Don't say bring the budget back in line, they've never done it and don't say protect the constitution, Bush and Cheney trampled that pretty smartly. The "party of no" shoved the prescription part of medicare down our throats without the government's power to negotiate the prices and got us into a trumped up war, Iraq - we'll be paying for that a long time. The "party of no" strikes the chords of fear and ignorance by distorting everything that emanates from Washington. When are people going to wise up and not dance to the tune of the Limbaughs, Becks, Hannitys and Levins - these people would be laughable if they weren't so dangerous. Every AG who wants to sue also wants to be governor. You're going to have get over the fact that a black man was elected president - it's not the end of the world.

Frivolous

I thought Republicans where AGASINT frivolous lawsuits and wasting taxpayers money on them? The fact that federal primacy rules the day and has been upheld by SCOTUS means this will be a huge waste of time and money. Of course this is something Republicans have never had a problem with. American Health is Great...For the Wealthy

It is not ironic at all. American health care has always been great for those with deep pockets. The problem is basic access to health care for all and financial protection for those with serious illnesses. Also, you are crazy if you think the millionaire Canadian premier came to the US b/c he was on a waiting list.

Not the Canadian Prime Minister

Just a correction: the Premier for the Province of Newfoundland was told that he needed a complex heart procedure, not the Prime Minister of all of Canada--get it straight. For those who have not studied geography, Newfoundland is a low population area with no major cities and not surprisingly no hospitals able to perform the recommended procedure. He had to leave the Province in order to have the surgery. He has created controversy over his decision to go to the US. Waiting lists were not part of the decision. The exact procedure is not public so it is not possible to know whether or not there is any hospital in Canada capable of performing the procedure, or maybe he was told that THE person to do this surgery was in the US, or what the reason was.

In my travels through Canada, everyone that I have spoken with has been happy with their medical care and think we are nuts. If you read the posts below, you will see that my Canadian friends are correct.

Car vs Health

Beachbum the difference is simple if I dont own a car I dont have to buy insurance. And the state requires the insurance not the Federal Government. The insurance is to cover damage to someone else or someone elses property not to cover me personally.
They have mandated that if you own a "Body" you have to buy insurance. Can you name any other laws were the possession of a "Body" requires you to purchase something?

Did you also know that there are many private companies that will handle procedures like Cat-Scans and MRIs in Canada if you pay out of pocket and they are making a ton, because people are tired of waiting for shotty care.

New Healthcare

The Republicans are suffering fro sour grape syndrom.
I like the new plan and was not crazy about the idea that everyone should have insurance..but you know what...if you get sick taxpayers pick up the tab...so you do need to protect yourself to be self relieant. Something I am sure Republicans seem to like people to be! I wish we had gone further and established a public option like the goverment of Canada gives their citizens... but I feel we have made one small step ahead. If the Republicans had so many good ideas why did they not pass a health care bill under Bush, they had 8 years to do it!

Each state now avoids having its Medicaid payments from the Federal government cut, which is in the billions of dollars. Who do you think will pay for the payments in the end - we the taxpayers...

It is also ironic to say that the Republicans waste money - aren't we building pier at the beach that costs millions of dollars during a recession. Didn't the federal government give out money to fake zip codes...and we waste money...

I see what you are saying and I think the lawsuit is pushing the same notion - the federal governemnt should not be given the authority force citizens of the U.S. to buy health insurance.

It is important to mentioned - there are two difference between health insurance and automobile. The government does not pick up the tab for the wrecked car of someone that does not have insurance. The government does pick up the tab of the sick person that goes into a hospital and has surgery with no insurance. You do not have to drive a car - we have public transportation. The government is now saying you have to have insurance regardless.

Your assumption that Berry and Troxler are doing this for political gains is laughable and unfounded. I can say that Cooper is not filing a lawsuit for political gains. A majority of North Carolinians do not support the legislation, thus Berry and Troxler are listening to their constituents - the job of a elected official. This legislation also directs the aspects of government in which Berry and Troxler oversee - small businesses.

Also - it is interesting that the legislation does not force Muslims or Amish to get healthcare based on religion...separation of church and state?

You are citing what is called the Supremacy Clause, which goes on to prove my point that the health care mandate contradicts the U.S. Constitution...

I n my own personal opinion both troxler & berry have always had the intentions of just using thier current office holdings as a platform to launch a potential bid for the governorship of this state. of which an when they do attempt to try an do so i personaly hope that they are an abmisal failure at such an attempt . i my opinion they have already slanted their current offices to the far right as it pertains to their authority as it pertaines to the state citzens being able to pursue any kind of actions thru their office to be able to receive any kind of injunctive releif under the state or federal laws of this contry thank you

Article Six of the Constitution ensures there is no state immunity to Federal regulation. Many states, upon introduction of this and other legislation have attempted to launch "sovereignty" resolutions and nullification acts to avoid federal regulations. Attempting to utilize Article Ten in this manner is weak at best...

Look up the Commerce Clause/Necessary and Proper Clause/etc. This health care legislation is well within the acceptable bounds of the powers granted to the Federal Government. None of these lawsuits will succeed.

I suggest you reread the Constitution in its entirety instead of regurgitating the parts you are attempting to utilize for this uninspired lawsuit.

How much insurance?

Someone please tell me what the minimum amount of health insurance one has to buy to avoid jail? What will that policy cover? What is the deductible? What if that insured cannot pay the deductible? Who will be on the hook for the unpaid bills, the citizens of North Carolina? Minor details.

Where in the constitution does it state that the Federal Government can pass a law to mandate the citizenry to purchase health insurance?

Thus, anything not granted to the federal government is reserved - showing that you A. have no ability to comprehend what you read B. are a liberal that has never read the Constitution...

Under the Constitution, Federal Law trumps State Law. These lawsuits are frivolous, come at great taxpayer expense, and achieve nothing. Let's hope our AG has more common sense. Perhaps our state can grant Troxler and Berry the "freedom" they desire by removing them from their appointments next term.
