Bill would deny bail to illegal aliens

Illegal immigrants would be denied bail under a new bill.

The bill was filed by freshmen Republican Reps. Pearl Burris-Floyd of Gaston County and Justin Burr of Stanly County.

It would instruct magistrates to have a presumption that no illegal immigrant charged with a sex offense, violent felony or driving violation, among other things, could be released with a reasonable presumption that they would return to court.

Sarah Preston, legislative director for the state chapter of the American Civil Liberties Union, said that it was overly broad and would cost too much money.

Burr said the bill was supposed to be broad.

"This is just a way to make sure these folks are being held and not put back on the streets," he said. (Burlington Times-News)

I just wanted to comment on FFC's mention of Hughes. This is/was the largest PR stunt known to man.

Ms. Hughes was at the Ft. Meyers townhall meeting for Obama to sell his economic stimulus package. After the delivery of his written speech, Pres. Obama opened the floor to questions. A staffer gave the mic to Ms. Henrietta Hughes, who happens to be homeless. After telling her story, she asked Pres. Obama for her "own kitchen and bathroom." Obama walked over and gave her a hug and told her that a staffer would be by soon to talk to her. The staffer ended up giving Ms. Hughes a card with the information of some top-level government official in DC. Soon after it is reported that the wife of a Florida Congressman has a spare house valued at $150,000 and decided to give the house to Ms. Hughes. The Congressman happens to be a Republican...PS. End of story and a fairy tale ending.

First of all, I have been working in the political world most of my life and I know that the people that get into these type of townhall meetings are either diehard supports, volunteers of the party or big time donors. Given Ms. Hughes great seats, my guess is that she was planted or was given a ticket to attend, perhaps she should have been out looking for work, but that is my opinion.

Anyways, she was wearing a well pressed black suit and it is clear that she has on a touches of make-up. Well given that she claimed she lived in a pick-up truck with her 38-year old son, must be hard to iron a suit in the back of a pickup truck as well as put on makeup.

Some on the board will resort to calling me insensitive, but I am just stating the facts of the case.

P.S. why isn't her 38 year old son stepping up and finding a job to help his mother, where is the sense of personal responsibility promoted by Obama?

Continuing on...so Ms. Hughes is the proud owner of house that is valued at $150,000. This is great step up for a woman that has been homeless for some time and cannot find work...

But she will have to pay taxes on the gift of the house, plus the property tax. These obstacles will be hard to overcome since she has no job. Perhaps ole Tim and Tom will show her how to avoid the taxes, but this honestly puts this woman in worse shape. She will only struggle and eventually have the house taken from her and the kind family that donated the house will lose potential money and assets from this contribution.

I am of the opinion that this might have been the greatest PR stunt ever seen.

How come the media is not giving Ms. Hughes the once over as Joe the Plumber received...fair is fair...

As a former Assistant District Attorney, I observed that Hispanic individuals are statistically far less likely to show up for their court date. It was unbelievable how many traffic court defendants had surnames of Hispanic origin: way over their proportion of the population. Go to www.nccourts.org and pull up some traffic court calendars and see for yoruself. Out of that conspicuously disproportionate number of Hispanic surnames, in my experience only a very small fraction ever attempted to address their traffic charge in any way whatsoever. Routinely less than 25% of presumedly Hispanic individuals would show up for their court date; often it was closer to 10%. In chambers before court, our (admittedly inappropriate) bailiff would get a chuckle of reading out loud the rhyming surnames on the calendar: "Lopez, Gomez, Perez, Rodriguez, Hernandez, Martinez, etc." Then he'd look up from the calendar and say, "Looks like it'll be a quick day, Mr. DA. They ain't gonna show."

I generally support comprehensive immigation reform that would allow many if not most current aliens to remain in the U.S. and work towards citizenship. Until that time I believe that we need to insist that illegal immigrants follow our (non-immigration) laws, including traffic laws. My perception is that a large number of Hispanics either aren't aware of our traffic laws or choose not to obey them. I can't believe that our current "enforcement" of those laws has much of a deterrent effect because illegal immigants know that they never have to actually show up for court. After all, they're not on the state's radar in the first place. It's cake to assume a new identity. On the other hand, if an official or unofficial policy to deny bail is put into place, I think that word will spread quickly and illegal immigrants will be much more careful about obeying the traffic laws. That will promote safety on the road, which is the ultimate point of having traffic laws. Make no mistakes, a lot of bad traffic accidents are caused by unlicensed drivers, a disproportionate number of whom are illegal aliens from Latin America.

With regard to the funding issues others have raised, if these folks actually start paying their traffic fines and court costs, I think the new policy would wind up paying for itself. At a minimum that revenue will mitigate some of the enforcement costs. As to folks who worry about relatively more dangerous criminals being let go, I don't think that's relevant to the discussion of the merits of this question, nor do I think it's particularly plausible.

My bottom line is that if we as a society are not willing to deport all illegal aliens, we owe it to law-abiding citizens to take measures to ensure that the illegals live by our laws. Denying bail for traffic violations is the first solution I've heard offered to address what is a very real danger to the citizens of this state: unlicensed, unregulated, uneducated, and unsafe drivers.

It's a redundant proposal that would be a waste of text space in the general statutes and it is grandstanding, posturing, and feel good politics at best. (as are many new laws) There exist ample provisisions in the current body of bail law that allow Magistrates to deny bail to IAs or any other arrestee (including legal immigrants) deemed to be a flight risk based on lack of ties to community, inability to present satifactory valid identification, or ability/propensity to flee to foreign jurisdictions. What is lacking is the political willpower (cojones) in the several judicial districts for the Magistrates, their Judge supervisors, and the District Court first appearance Judges to rigorously exercise these discretions and force the arrestee to make his own case instead of putting a magistrate in the untenable position of being an ICE agent pursuant to a new state law that the ACLU nimrods will probably be able to shoot down. I'm on board with the ostensible spirit of this proposal, but poorly crafted legislation is poorly crafted legislation regardless of the ideology behind it.

Then you'll be willing to have your State & Local taxes raised to build more jail cells and pay for more guards and the costs of detention.

This measure will further dilute the ability to deal with criminals by increasing stats for minor offences, increasing costs and spreading thin resources even more thinly.

Domestic criminals will roam the streets with impunity because our jails will be crowded with people with broken tail lights who overstayed their visas waiting for a backlogged federal system to process them.

The bill has another provision to allow for detention without bail of an immigrant for any other offence not listed as long as ICE agrees to pick up the tab.
