Democrat Sam Ervin IV is leading Republican Paul Newby in the all important race for the N.C. Supreme Court, according to a new poll.
Ervin leads Newby by a 31-23 margin margin, according to a survey by Public Policy Polling, a Democratic leaning firm based in Raleigh. But the key figure is that 46 percent of the voters are undecided in what has been a low profile race that will ultimately tip control of the court in either Democratic or Republican hands.
Ervin is winning 44 percent of the Democrats, while only 37 percent of the Republicans are committed to Newby. The race is officially non partisan. Newby sits on the Supreme Court, while Ervin is a judge on the Court of Appeals.
The survey of 981 likely voters was conducted Sept. 27-30 and had a margin of error of plus or minus 3.1 percent.
